Lasting Power of Attorney

What is a Lasting Power of Attorney (LPA)?

A Lasting Power of Attorney is a legal document which grants a trusted individual the authority to make decisions on your behalf when you’re unable to do so yourself. It allows you to designate someone you trust to manage your affairs, whether related to your health and welfare or your property and financial matters.

You must be 18 or over and have mental capacity – the ability to make your own decisions – when you make your LPA.

There are 2 types of LPA:

  • – health and welfare lasting power of attorney
  • – property and financial affairs lasting power of attorney

You can choose to make one type or both.

 

Health and Welfare LPA

The Health and Welfare LPA empowers you to appoint a trusted individual, known as an attorney, to make decisions about your health and personal care when you are unable to do so. This includes decisions about medical treatment, living arrangements, and other important aspects of your well-being. By creating a Health and Welfare LPA, you ensure that your wishes are respected and your best interests are protected.

 

Financial LPA

A Financial LPA grants authority to your chosen attorney to handle your financial affairs on your behalf. This includes managing your bank accounts, paying bills, collecting benefits, and making decisions about investments or property transactions. By establishing a Financial LPA, you can have peace of mind knowing that your finances are in capable hands, even if you become incapacitated.
